General Terms and Conditions for RadixChat

1. Provider and scope

These General Terms and Conditions apply to the use of RadixChat via the website and the associated applications.

These terms apply to free test access as well as paid access and additional RadixChat services.

The service is intended for consumers within the meaning of § 13 of the German Civil Code (BGB), unless otherwise stated in the respective offer.

2. Subject matter of RadixChat

RadixChat is a digital application that may provide the following functions in particular:

The specific scope of functions depends on the type of access used and the scope of services described when the contract is concluded.

Astrological interpretations and AI-generated content are intended for information and self-reflection. In particular, they do not constitute medical, psychotherapeutic, legal, tax or other professional advice.

AI-generated content may contain errors, inaccuracies, contradictions or incorrect conclusions. Users remain responsible for decisions they make based on such content.

3. Registration and user account

A personal user account is generally required to use RadixChat.

Users must provide truthful information required for registration and protect their access credentials from third-party access.

A user account is intended for personal use. Sharing access credentials or jointly using a personal account with several people is not permitted.

Users must notify the provider without delay if they become aware of unauthorized use of their account.

4. Free test access

RadixChat may offer registered users free test access.

Free test access is not time-limited. Its functionality is restricted compared with paid full access.

The functions and usage limits available in test access are set out in the current description of the test offer.

Providing free test access does not create any entitlement to a particular scope of functions or permanent free provision of individual functions.

The provider may change the scope of free test access for the future, provided this does not conflict with the user’s statutory rights.

Free test access does not automatically convert into paid access or a subscription. A paid contract is concluded only when the user expressly orders a corresponding paid offer.

No payment data is required for free test access unless expressly stated otherwise in the specific offer.

5. Paid full access

By purchasing full access, the user receives access without a fixed time limit to the core RadixChat functions specified in the respective offer.

These may include in particular:

After the one-time payment, full access is not dependent on any further recurring basic fee.

“Without a fixed time limit” or comparable wording does not oblige the provider to operate RadixChat indefinitely or for life. Access generally exists for the duration of RadixChat’s operation in accordance with these terms and statutory provisions.

The applicable price and specific scope of services are shown to the user before the paid order is completed.

6. AI use included after purchasing full access

On purchasing full access, the user additionally receives for the first billing month the number of AI credits stated in the relevant offer.

This AI usage budget is stated as a number of AI credits. AI credits are internal units of consumption, not a currency, and have no fixed equivalent value in euros or any other currency. The number of AI credits granted with full access is shown together with the total price before purchase.

The included AI credits are intended exclusively for using RadixChat’s AI functions.

Unused AI credits included with full access expire at the end of the first usage period. They are neither paid out nor carried over to a later period.

The first included usage period does not by itself create an obligation to continue AI use permanently unless the ordering process expressly provides for conclusion of a corresponding subscription.

7. Continued AI use and monthly subscription

If the user concludes a monthly AI subscription, or such a subscription is agreed in accordance with the offer expressly presented during ordering, the user receives for each paid billing period the number of new subscription AI credits stated in the relevant offer.

The applicable monthly total price, the exact number of subscription AI credits included, the start of the subscription and the billing period are shown before the contract is concluded.

Unused subscription AI credits expire at the end of the relevant billing period and are not carried over to the following period.

The AI subscription can be cancelled independently of full access.

Ending the AI subscription does not automatically end full access or the user account.

After the AI subscription ends, functions belonging to full access remain available for as long as RadixChat is operated. Existing paid additional AI credits remain available in accordance with these terms.

While the AI subscription is active, automatic translations of the user’s own future forum posts and subsequent comments may be included without charging personal AI credits. Private-message translation requires both participants’ consent. The user can disable the automation at any time.

8. Additional AI credits purchased separately

Where this function is offered, the user may purchase additional AI credits. The exact number of AI credits and the total price payable in the relevant billing currency are shown before purchase.

These additional AI credits are intended exclusively for using the designated AI functions of RadixChat.

Paid additional AI credits do not expire at the end of a monthly billing period.

When AI features are used, existing paid additional AI credits are consumed first. Only when no such credits remain are any available subscription AI credits charged.

Users should therefore note that additional AI credits purchased during a current billing period are consumed before any remaining subscription AI credits that expire at the end of the period.

The credit charge for an AI request depends in particular on the language model used, the number of input and output tokens processed and the context included in the request.

Because the response length is known only during processing, the exact credit charge can generally be determined only after an AI request has been completed. RadixChat displays the relative price factor of the selected language model before use and the number of AI credits actually deducted after the request.

The technical calculation of the credit charge takes account of the usage costs incurred for the AI model used and the conversion and cost factors stored in RadixChat. The resulting charge is shown to the user exclusively as AI credits.

AI credits cannot be transferred to another user account, exchanged for money or paid out. Statutory reimbursement rights remain unaffected.

Where reimbursement is due, it is generally made through the original payment method. Purchases made through Apple or another distribution platform are also subject to that platform’s reimbursement procedure. AI credits assigned to a reimbursed purchase are removed from the user account to the extent that they are still available.

9. AI language models and external services

Language models and technical services from external providers may be used for RadixChat’s AI functions.

There is no entitlement to the permanent availability of a particular language model or model version.

Language models may be replaced or removed due in particular to technical development, discontinuation by the provider, changed availability or other objective reasons.

If such a change materially impairs the contractually owed use, the user’s statutory rights remain unaffected.

10. Forum and netiquette

Full access may include use of the RadixChat forum.

Before first actively using the forum, the user must accept the netiquette or forum rules displayed there.

The netiquette supplements these terms regarding conduct within the forum.

The provider may moderate posts and remove or restrict the visibility of unlawful content and content that materially violates the netiquette.

In the event of serious or repeated violations, the user’s forum access may be restricted temporarily or permanently. Further statutory rights remain unaffected.

11. Forum posts after deletion of a user account

When a user account is fully deleted, previously published forum posts may generally be retained unless there are statutory grounds for their deletion.

The association between such posts and the deleted account is removed. The former author is then displayed, for example, as “Deleted user”.

If a forum post itself contains personal data or other statutory deletion claims apply, these are handled separately.

12. Chat histories and users’ own content

RadixChat may store AI conversations conducted by the user and other content created by the user where this is provided for the offered functions.

Users can use available copying or other backup functions to save content that is important to them.

When the user account is fully deleted, personal chat and user data is deleted in accordance with statutory requirements and the privacy policy, unless statutory retention obligations or other legal grounds prevent deletion.

13. Prices and payment

The applicable prices are shown to the user before a paid order is completed.

Unless stated otherwise, prices quoted to consumers are total prices including statutory VAT.

The available payment methods are displayed in the respective ordering process.

Payments may be processed through external payment or distribution platforms, in particular PayPal, the Apple App Store or Google Play. The terms of the platform used also apply. The purchase price, billing currency and any local taxes are shown in the relevant order process.

14. Term and cancellation of the AI subscription

A monthly AI subscription runs for the billing period specified when the contract is concluded and renews in accordance with the offer presented at that time unless it is cancelled.

Cancellation takes effect on the next contractually available date. Subscriptions concluded through a distribution platform are managed and cancelled through the account used on that platform; for other payment methods, the cancellation option offered in RadixChat is provided.

Cancelling the AI subscription does not delete the user account or cause the loss of full access already purchased.

Statutory electronic cancellation options remain unaffected.

15. Deletion of the user account

The user can request full deletion of the account or use an account-deletion function provided for this purpose.

Deletion of the user account must be distinguished from merely cancelling an AI subscription.

Full account deletion ends the ability to access functions and personal data associated with that account.

The reimbursement provisions in section 8 apply to any remaining paid and unused additional AI credits. Deleting the account does not affect mandatory statutory rights.

Forum posts already published may be retained in anonymized form in accordance with section 11.

16. Availability and technical requirements

RadixChat is provided over the internet. Use requires a suitable internet connection and compatible device, suitable browser or supported app version.

The provider does not owe uninterrupted availability at all times where temporary restrictions arise in particular from necessary maintenance, security measures or technical faults beyond the provider’s control.

The user’s statutory rights in the event of defects or non-conforming provision remain unaffected.

17. Changes and further development of RadixChat

RadixChat is continuously developed technically and in terms of content.

The provider may change, supplement or technically replace functions where there is an objective reason and the change is reasonable in light of the user’s interests and legally permissible.

Statutory information, preservation, termination and other user rights relating to changes to digital products remain unaffected.

18. Permanent discontinuation of RadixChat

The provider may permanently discontinue RadixChat for a substantial economic, technical, legal, organizational or personal reason where legally permissible.

Affected users will be notified of a planned permanent discontinuation with reasonable advance notice unless compelling reasons require a shorter period.

The ability to continue using the service ends when RadixChat is finally discontinued.

Current AI subscriptions will end no later than discontinuation of the service. No further recurring RadixChat charges will be collected after that point.

Remaining paid and unused additional AI credits are reimbursed in accordance with statutory provisions and section 8 through the original payment method or the procedure of the distribution platform used.

Unused free AI credits or subscription AI credits are not paid out.

The user’s statutory claims, particularly in connection with digital products and fees already paid, remain unaffected.

19. Suspension in cases of misuse

The provider may temporarily suspend a user account or individual functions where there are concrete indications of substantial misuse of RadixChat.

This may include in particular:

The nature and severity of the violation and the user’s legitimate interests are taken into account when deciding the type and duration of a measure.

20. Rights in RadixChat and user content

RadixChat software, design, proprietary texts, graphics, logos and other content are protected in accordance with statutory provisions.

The user receives the rights of use necessary for personal use in accordance with the contract.

Users retain their rights in content they create themselves.

Where necessary to provide the forum or other functions, the user grants the provider the required non-exclusive rights of use for the duration and purpose of the respective provision.

21. Warranty and liability

The statutory warranty and defect rights apply to provision of RadixChat, including the statutory provisions on digital products where applicable.

The provider has unlimited liability for damage resulting from injury to life, limb or health, for damage caused intentionally or through gross negligence, and in other cases where liability is mandatory by law.

In all other respects, liability is governed by statutory provisions.

The information in section 2 on the limitations of astrological and AI-generated content remains unaffected.

22. Right of withdrawal

Consumers have a statutory right of withdrawal for distance contracts unless this right is legally excluded or has expired.

Details are set out in the separate Withdrawal policy, which is provided to the user in connection with conclusion of the relevant contract.

If the user requests that provision of a digital service begin during the withdrawal period, the legally required declarations are obtained separately during the ordering process.

23. Changes to these terms

Changes to these terms for existing contractual relationships are made only where there is a valid contractual or statutory basis.

Where the user’s consent is required, it will be obtained.

The user will be informed appropriately of material changes.

The user’s statutory rights remain unaffected.

24. Final provisions

The law of the Federal Republic of Germany applies, excluding provisions that cannot permissibly be waived in relation to consumers.

If the consumer is habitually resident in another country, mandatory consumer-protection provisions of that country remain unaffected where they apply by law.

The contractual language is German.

If individual provisions of these terms are or become invalid, the statutory provisions concerning the consequences of invalid standard terms remain unaffected.
